一. The city’s plastic pollution control work
Shanghai has always attached great importance to the control of plastic pollution. According to the national deployment and arrangement of plastic pollution control, ten departments including the Municipal Development and Reform Commission and the Municipal Bureau of Ecology and Environment jointly formulated and issued the “Shanghai Implementation Plan for Further Strengthening the Control of Plastic Pollution” ( Shanghai Development and Reform Regulations [2020] No. 20), and incorporate plastic pollution control into Shanghai’s “14th Five-Year Plan” economic and social development plan and circular economy development plan for implementation. Established a promotion mechanism for plastic pollution control work in Shanghai, formulated annual key task arrangements for plastic pollution control work, held work promotion meetings, and conducted follow-up assessments of policy implementation.

During the formulation of Shanghai’s “Implementation Plan”, in view of the actual situation of the city’s domestic waste disposal at the end, the promotion of degradable plastic bags was not emphasized, mainly because the city’s primary domestic waste basically achieved zero landfill, and the promotion of degradable plastic bags is not practical big. Among them: dry waste is fully incinerated, and there is no difference whether it is degraded or not; the disposal method of wet waste is basically anaerobic fermentation, and there is a lack of site conditions for aerobic composting of degradable plastic bags.
To this end, Shanghai’s “Implementation Plan” is guided by the concept of “circular economy”, highlighting “reducing sources, controlling ends, promoting circulation, and preventing leakage”, and builds a management model covering the entire life cycle of plastic products. Put forward stricter restrictions on plastic shopping bags than the state, that is, prohibit the use of disposable plastic shopping bags (both degradable and non-degradable) in five scenarios, including shopping malls, supermarkets, pharmacies, bookstores, and various exhibition activities. , and encourage citizens to bring their own shopping bags to the above-mentioned places for shopping. By promoting the use of environmentally friendly shopping bags such as cloth bags and non-woven fabrics that can be repeated many times, the use of disposable plastic bags can be greatly reduced, and the purpose of reducing disposable plastic products at the source is achieved.
In order to further strengthen the reduction and recycling of single-use plastic products at the source, we have focused on the following aspects: First, in order to strengthen the understanding of the policies of shopping malls, supermarkets and other enterprises, we have organized and carried out plastic pollution control policy publicity and implementation training, accumulative coverage There are more than 2,700 people in various shopping malls and supermarkets. The second is to organize the pilot application of recyclable express packaging, and select 8 companies including Fuhai (Shanghai) Internet of Things Co., Ltd. through the application review to carry out a one-year pilot application of recyclable express packaging in Shanghai, focusing on For cold chain fresh food and other categories, we strive to explore a reproducible, scalable and sustainable application model of recyclable express packaging. The third is to strengthen the recycling of plastic waste. Organize and carry out separate recycling pilots for plastic recyclables to improve the standardized recycling level and recycling rate of plastic waste. Fourth, encourage the development of recycling enterprises, issue and implement the “Implementation Opinions on Further Supporting the Stable Development of Shanghai’s Resource Recycling Industry” to solve the problems of “difficulty landing”, “instability”, and “low energy level” for resource recycling enterprises, encourage Explore and promote environmentally friendly bag products that can be recycled and continuously improve the level of resource recycling.

At the same time, we have also stepped up efforts to collect and clean up plastic waste to minimize the risk of environmental leakage. The first is to establish a city-wide household garbage collection, removal and transportation system, including rural areas and all A-level tourist attractions into the integrated urban and rural household garbage collection, transportation and disposal system, and put domestic garbage collection facilities in accordance with relevant standards; the second is to strengthen rivers and rivers The salvage and clean-up of plastic waste in lakes and seawalls has continued to reduce the amount of environmental leakage of plastic waste by carrying out a series of actions such as normalized water surface cleaning, beach cleaning, receipt of domestic waste from ships, and supervision and law enforcement.

二. My country’s current regulations on market access and standard formulation and revision
Regarding your committee’s proposal to “improve the entry threshold for non-woven bag production”, according to the “Administrative Licensing Law of the People’s Republic of China”, in general, administrative licensing should be set by laws and administrative regulations. Local regulations may set administrative licenses, but the administrative licenses set by them shall not restrict individuals or enterprises from other regions to engage in production, operation and provision of services in the region, and shall not restrict the entry of goods from other regions into the market of this region. At present, the state implements the production license system management for important industrial products, and non-woven bags are not included in the catalog of industrial products that implement the production license system. According to the existing laws, regulations and policies, there is no basis for local governments to raise the entry threshold for non-woven bag production, and it does not comply with the relevant provisions of the Administrative License Law.
Regarding the “formulation of local standards for degradable plastics” proposed by your committee, Article 22 of my country’s “Standardization Law” stipulates that “it is prohibited to use standards to impede the free circulation of goods and services to eliminate or restrict market competition.” Order No. 26 of the State Administration for Market Regulation, “Administrative Measures for Local Standards,” further clarifies that “it is prohibited to use local standards to impede the free circulation of goods and services to exclude or restrict market competition by formulating local standards for product quality and inspection methods.” Degradable plastic is a product standard, and it belongs to the field that the state prohibits the formulation of local standards.

In the next stage, the member units of the city’s plastic pollution control work promotion mechanism will continue to implement the relevant regulations on prohibiting and restricting the production, sales and use of some plastic products in accordance with the country’s new deployment and new requirements for plastic pollution control during the “14th Five-Year Plan”. , track the progress of the pilot application of recyclable express packaging, while vigorously promoting the reduction of the source of disposable plastic products, further improve the waste plastic recycling system, and continuously improve the measures to strengthen the risk management and control system of end leakage.
